Terms & Conditions – Paddy’s Presents Pty Ltd

1. Introduction

1.1. These Terms and Conditions (“Terms”) govern your access to and use of the services, website, promotions, giveaways, and any other goods or services (collectively “Services”) provided by Paddy’s Presents Pty Ltd (ACN: 687858617) (“we”, “us”, “our”).

1.2. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Services.

2. Eligibility

2.1. You represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2.2. For trade-promotion lotteries, entries are open only to residents in Australia, excluding residents of South Australia and the Australian Capital Territory.

2.3. You must comply with any eligibility requirements for giveaways or promotions as specified in these Terms.

3. Use of Services

3.1. You agree to use the Services only for lawful purposes and in accordance with these Terms.

3.2. You agree not to misuse or interfere with the Services or attempt to access them in unauthorized ways.

4. Orders and Participation

4.1. Participation in giveaways and promotions is subject to the specific terms provided at the point of entry.

4.2. We reserve the right to refuse or cancel any order or participation at our sole discretion.

4.3. All prizes or giveaways are subject to availability.

5. Price and Payment

5.1. All prices are in Australian dollars ($AUD) and inclusive of GST. Price references to Euro (€) are strictly for approximate comparison purposes only and are liable to fluctuate throughout the duration of the promotion.

5.2. Payment methods accepted will be detailed at checkout and may be subject to change.

5.3. We reserve the right to reject or cancel any order if payment cannot be processed.

5.4. Prices may change without notice and apply only to orders placed after such changes.

6. Promotions and Offers

6.1. Promotions, giveaways and special offers are subject to Section 7 (Trade Promotion Lottery – Specific Terms) and any additional rules displayed at the time of participation.

6.2. Offers cannot be combined unless expressly stated.

6.3. We reserve the right to cancel or amend any promotion without prior notice, provided that such amendment does not materially disadvantage entrants.

7. Trade Promotion Lottery – Specific Terms

A) Win VW Golf R or $20,000 Cash Alternative

7.1. Promotion Period
The promotion commences at 12:00 PM AWST on 13/11/2025 and closes at 14:00 PM AWST on 04/12/2025 (“Promotion Period”).

7.2. Eligibility
Entry is open to Australian residents aged 18 years or older, excluding residents of South Australia and Australian Capital Territory. Employees, contractors, and immediate family members of Paddy’s Presents Pty Ltd are not eligible.

7.3. How to Enter
Each purchase of a Paddy’s Presents digital product bundle during the Promotion Period provides the purchaser with free entries into the trade promotion lottery. Entries vary depending on the bundle selected.

7.4. Draw Details
The draw will take place at 6:00 PM AWST on Friday, 5 December 2025 via Facebook Live (Account: @Paddyspresents). The draw will be conducted randomly using Google Random Number Generator.

All Entrants will be sent an email prior to the draw with their draw numbers randomly assigned.

7.5. Prize(s)

The winner may choose one of the following:

$20,000 AUD Cash Alternative

7.6. Winner Notification

Winners will be notified by phone on the Live Draw. They will subsequently by notified via email within two (2) business days of the draw. Paddy’s Presents reserves the right to use footage calling and notifying the winner on their Social Media platforms. For any prize valued over AUD $250, the winner’s first name, surname initial, suburb, and state will be published on our website www.paddyspresents.com within seven (7) days of the draw.

7.7. Unclaimed Prizes
If a prize is not claimed within 30 days of notification, a redraw will take place at the same location on 01/01/2026 using the same method. The redraw winner will be notified as above.

7.8. Verification
Winners and any associated companion(s) may be required to provide proof of identity, age, and residency to claim a prize. Failure to do so may result in forfeiture of the prize.

7.9 Taxation

Winners are solely responsible for any tax implications arising from accepting the prize. Cash prizes may be considered taxable income, and winners should seek independent financial advice.

B) Win FREE Return Flights to Ireland / UK Plus 2 x Electric Picnic Tickets

7.1. Promotion Period
The promotion commences at 1:00 PM AWST on 24/11/2025 and closes at 23:00 PM AWST on 04/12/2025 (“Promotion Period”).

7.2. Eligibility
Entry is open to Australian residents aged 18 years or older. Employees, contractors, and immediate family members of Paddy’s Presents Pty Ltd are not eligible.

7.3. How to Enter
Entry is 100% Free of Charge and the promotor will not collect any revenue from this specific promotion throughout the duration of the promotion

All Entrants will be sent an email prior to the draw with their draw numbers randomly assigned.

7.5. Prize(s)

The winner may choose one of the following:

Economy Return Flights from Australia to Ireland or UK plus 2 x Concert tickets to Electric Picnic 2026. The promotor will book the respective flights with full autonomy to choose a reputable airline and the respective flight times.
$3,000 AUD Cash Alternative

7.6. Winner Notification

Winners will be notified by phone on the Live Draw. They will subsequently by notified via email within two (2) business days of the draw. Paddy’s Presents reserves the right to use footage calling and notifying the winner on their Social Media platforms. The winner’s first name, surname initial, suburb, and state will be published on our website www.paddyspresents.com within seven (7) days of the draw.

7.10 Prize Details

Paddy’s Presents are not responsible in and circumstance where there is a delay, cancellation or event causing which effects the flights. Paddy’s Presents are not responsible for any circumstances stemming as a result from the Promotion which causes the Prize Winner to miss a flight, misplace any luggage or be involved in an Airline Crash. By entering the Giveaway the Entrant understands and agrees that the Promoter’s involvement fully ceases once the flights are booked and the prize is transferred to the Winner.

7.11 Permit

NA – Prize Value is below $5,000 and is 100% Free to Enter

8. Returns and Refunds

8.1. Our digital bundles are non-refundable once delivered, except as required under the Australian Consumer Law. Where an order is cancelled or refunded under the ACL, any related giveaway entries will also be cancelled.

9. Intellectual Property

9.1. All intellectual property rights in the Services and content belong to us or our licensors.

9.2. You are granted a limited, non-exclusive license to use the Services for personal, non-commercial use only.

9.3. You must not copy, reproduce, or misuse our intellectual property without written permission.

10. User Content

10.1. You may be able to submit content such as reviews, images, or comments (“User Content”).

10.2. By submitting User Content, you grant us a worldwide, royalty-free, sublicensable license to use, modify, and display the content in connection with the Services.

10.3. You warrant that you own or have rights to all User Content and that it does not infringe any third-party rights or laws.

10.4. We may remove or refuse to publish any User Content at our sole discretion.

11. Feedback

11.1. We welcome feedback and suggestions but are under no obligation to act on them.

11.2. By providing feedback, you grant us a perpetual, irrevocable license to use it without compensation.

12. Third-Party Links and Social Media

12.1. Our Services may contain links to third-party websites or platforms. We do not control or endorse these and are not responsible for their content or practices.

12.2. Use third-party sites at your own risk and review their terms and policies.

13. Privacy

13.1. We collect and use personal information as described in our Privacy Policy, which forms part of these Terms.

13.2. By entering a trade promotion lottery, you consent to your name, suburb, and state being published if you are a winner, as required by law.

14. Disclaimers and Liability

14.1. To the maximum extent permitted by law, we exclude all warranties, conditions, and liabilities arising out of or related to the Services.

14.2. We are not liable for indirect, incidental, consequential, or punitive damages.

14.3. Nothing in these Terms limits your rights under Australian Consumer Law.

15. Indemnity

15.1. You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of the Services.

15.2. The Promoter is not responsible for, and accepts no liability for, any loss, damage, injury or disappointment incurred by the winner or any associated companion(s) in connection with or during the use of the prize, except for liability which cannot be excluded by law.

16. Termination

16.1. We may suspend or terminate your access to the Services at any time for breach of these Terms or suspicious activity.

16.2. Termination does not affect accrued rights or liabilities.

17. Governing Law and Jurisdiction

17.1. These Terms are governed by the laws of Western Australia.

17.2. You submit to the non-exclusive jurisdiction of the courts in Western Australia.

18. Changes to Terms

18.1. We may update these Terms from time to time. Changes apply to orders or participation after the update.

18.2. Continued use of Services after changes constitutes acceptance.
